Gas Safety Certificate (CP12)

Safety Certificates
Every 12 months

Annual inspection of all gas appliances, fittings, and flues by a Gas Safe registered engineer.

Penalty for non-compliance: Up to £6,000 fine or 6 months imprisonment

Requirements:

  • Must be carried out by Gas Safe registered engineer
  • Copy given to existing tenants within 28 days
  • Copy given to new tenants before move-in
  • Keep records for at least 2 years

Pro Tips:

  • Book inspections 2 months before expiry
  • Use the same engineer for consistency

Electrical Installation Condition Report (EICR)

Safety Certificates
Every 5 years

Inspection of electrical installations including wiring, sockets, and consumer unit.

Penalty for non-compliance: Up to £30,000 fine

Requirements:

  • Must be carried out by qualified electrician
  • Required for all new tenancies since July 2020
  • Existing tenancies must have EICR by April 2021
  • Remedial work must be completed within 28 days

Pro Tips:

  • Check electrician is Part P registered
  • Address any "C2" codes immediately
  • Combine with PAT testing for efficiency

Energy Performance Certificate (EPC)

Safety Certificates
Valid for 10 years

Assessment of property energy efficiency. Minimum E rating required to let.

Penalty for non-compliance: Up to £5,000 fine per property

Requirements:

  • Minimum rating of E required since April 2020
  • Rating of C proposed for future (dates TBC)
  • Must be provided to prospective tenants
  • Display rating on property adverts

Pro Tips:

  • Invest in improvements to achieve C rating
  • Loft insulation often gives best ROI
  • Check for grants (ECO4, LADS)

Deposit Protection

Legal Requirements
Within 30 days of receipt

Tenant deposits must be protected in a government-approved scheme within 30 days.

Penalty for non-compliance: 1-3x deposit amount + cannot use Section 21

Requirements:

  • Use TDS, DPS, or MyDeposits scheme
  • Provide prescribed information to tenant
  • Protect within 30 calendar days
  • Re-protect if tenancy becomes periodic (same terms)

  • Use custodial scheme for simplicity
  • Keep proof of PI being served
  • Document property condition thoroughly

Tenant Information

Smoke & Carbon Monoxide Alarms

Working smoke alarms on each storey and CO alarms in rooms with fuel-burning appliances.

Penalty for non-compliance: Up to £5,000 fine

Requirements:

  • Smoke alarm on every storey with living accommodation
  • CO alarm in rooms with solid fuel burning appliances
  • CO alarms required in rooms with gas appliances (from Oct 2022)
  • Check alarms are working at tenancy start

  • Install sealed battery alarms (10-year life)
  • Test during property inspections
  • Replace when they start chirping

Landlord Licensing

Legal Requirements
Check annually / when licensing schemes change

Check if your property requires HMO, selective, or additional licensing from your council.

Penalty for non-compliance: Unlimited fine + rent repayment orders

Requirements:

  • Mandatory HMO licensing for 5+ tenants, 2+ households
  • Additional and selective licensing varies by council
  • Check with your local authority
  • Display license number if required
